These Terms of Use (the "Terms") govern access to and use of the website joingrowthfoundry.com (the "Site"), operated by GROWTH FOUNDRY LLC, a New Mexico limited liability company with its address at 1209 Mountain Road Pl NE Ste R, Albuquerque, NM 87110, USA (the "Company"). By accessing or browsing the Site you accept these Terms. If you do not agree with them, do not use the Site.
1. Purpose and scope of the Site
The Site presents the Company, its approach and its consulting services in business strategy, process optimization, sales performance and management, and offers a contact form to request a Business Assessment. The Site is informational and promotional: it describes services at a general level so you can decide whether to contact us.
Nothing on the Site — including service descriptions, The Foundry Method™, engagement formats, articles or answers in the FAQ — creates a client relationship, constitutes a binding offer or proposal, guarantees availability of any service, or replaces a signed services agreement. Scope, fees, timelines, deliverables, responsibilities, warranties and every other commercial term of an engagement are established exclusively in a written agreement signed by the Company and the client.
2. Use of the contact form
The contact form exists to send us genuine business inquiries. When you use it you undertake to provide truthful information and to have authority to share whatever information you send about a business. Submitting the form does not obligate the Company to respond within any particular time, to accept an engagement or to provide services; it opens a conversation, nothing more. The processing of personal data submitted through the form is governed by our Privacy Policy.
3. Intellectual property
All content on the Site — texts, headlines, structure, brand names, the GROWTH FOUNDRY name and logo, the FORGE. OPTIMIZE. GROW. tagline, The Foundry Method™ and its five-step designation, graphic designs, images, page layouts and code — is owned by or licensed to the Company and is protected by copyright, trademark and other intellectual property laws of the United States and international treaties.
You are granted a limited, revocable, non-exclusive, non-transferable license to view the Site and to print or store extracts for your own internal, non-commercial evaluation of our services. Any other use — reproduction, distribution, public communication, modification, framing, systematic extraction of content, or use of our marks — requires prior written authorization from the Company. Nothing on the Site grants any license over The Foundry Method™ as a methodology or over its trade identity.
4. Acceptable use
When using the Site you agree NOT to: (a) access, probe or test the Site's security, or attempt to bypass any technical protection; (b) introduce malware, scripts or any code intended to alter the Site or its infrastructure; (c) scrape, crawl or extract Site content in bulk, whether manually or with automated tools, beyond ordinary search-engine indexing; (d) use the contact form to send spam, advertising, mass mailings or unlawful content, or to impersonate another person or company; (e) overload the infrastructure through abusive request volumes; or (f) use the Site in any way that infringes applicable law or the rights of third parties.
The Company may block access, without prior notice, to any user or system that breaches these rules, and reserves all legal actions available to it.
5. Third-party sites and services
The Site may contain links to third-party websites or services. They are provided for convenience only: the Company does not control them, does not endorse their content and is not responsible for their availability, accuracy, security or privacy practices. Accessing a third-party site through a link on this Site is at your own risk and subject to that site's own terms.
6. No guarantee of outcomes
Business, marketing, sales, technology and operational outcomes depend on many factors outside the Company's control: execution, market conditions, competition, resources, timing and the client's own decisions. The examples, frameworks, engagement formats and descriptions published on the Site are illustrations of how we work, not promises of revenue, savings, conversion, productivity or any other specific result. The Site deliberately publishes no performance figures unless they are real, verified and approved by the client involved, as described in our Disclaimer.
7. Site availability and content accuracy
The Company strives to keep the Site available, accurate and up to date, but does not guarantee uninterrupted availability, freedom from errors, or that the content reflects the most recent state of its services at every moment. The Company may modify, suspend or withdraw any part of the Site at any time without prior notice.
8. Disclaimer of warranties and limitation of liability
To the maximum extent permitted by applicable law, the Site is provided "as is" and "as available", and the Company disclaims all warranties, express or implied, regarding the Site itself, including merchantability, fitness for a particular purpose and non-infringement, in each case solely as they relate to the use of the Site.
To the same maximum extent, the Company shall not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunity, arising from or related to the use of, or inability to use, the Site. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud. Liability connected to consulting services is governed exclusively by the signed client agreement for each engagement, not by these Terms.
9. Indemnification
You agree to indemnify and hold the Company harmless from claims, damages and reasonable costs (including attorney fees) arising from your breach of these Terms or your unlawful use of the Site, except to the extent the harm was caused by the Company itself.
10. Governing law and venue
These Terms and any dispute arising from the use of the Site are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-law rules. The state and federal courts located in Bernalillo County, New Mexico shall have exclusive jurisdiction over such disputes, without prejudice to mandatory consumer protections that grant you the courts of your place of residence where applicable law so requires.
11. Severability and waiver
If any provision of these Terms is held invalid or unenforceable, the remaining provisions keep their full force, and the invalid provision shall be replaced by a valid one that best matches its intent. The Company's failure to enforce any provision is not a waiver of its right to enforce it later.
12. Changes to these Terms
The Company may update these Terms when the Site, its services or the law change. The version in force is the one published on this page, identified by its effective date. Continued use of the Site after a change constitutes acceptance of the updated Terms.
